Decisions in relation to Exceptional Circumstances and Appeals services for the National Qualifications are an operational matter for the Scottish Qualifications Authority (SQA).

Figures quoted in a recent media article related to SQA’s Exam Exceptional Circumstances Consideration Service (EECCS). SQA is the only awarding body in the UK that offers an exceptional circumstances service which specifically reviews alternative evidence. It has been designed to offer young people the best opportunity to demonstrate evidence of attainment if their examination experience is impacted by, for example, bereavement, illness or other personal circumstances. This is a pre-certification process, with requests being submitted within 10 working days after the relevant exam. This means that if a young person experiences bereavement or other personal circumstance ahead of an exam, they can ask for alternative evidence to be taken into account when their grade is being determined – whether or not they are able to attend the exam.

The SQA Appeals service is a separate process that takes place following certification for learners who consider they have not achieved their expected results, and involves a marking review of SQA-marked assessments. Candidates who have undergone exceptional circumstances consideration are excluded from the Appeals Service for the same qualification. This is because the EECCS includes a marking review of any/all submitted external assessments that are related to the request.

SQA provided figures in response to a Freedom of Information (FOI) request from The Herald newspaper on the number of EECCS requests made and cancelled. SQA do not categorise EECCS requests as successful or rejected. It is incorrect to interpret the data as showing that the SQA did not approve over 90% of exam appeals made on the grounds of bereavement.

While SQA may cancel an EECCS request in some circumstances (where, for example, estimates had not been provided, coursework not completed, or a lack of supporting evidence), a larger number of requests are cancelled by the candidate’s centre (school, college or training provider).

For personal circumstances, such as bereavement, the type of EECCS request submitted is determined by the Head of Centre. SQA do not assess the reason for the request or require access to further details regarding the submission. A centre may cancel an EECCS request if they later determine that either there is not a justification for the request, or the alternative evidence available is not sufficient.

To maintain impartiality and fairness, examiners are not provided with any information about the nature of an EECCS request. This is an important safeguard that has been built into the EECCS to ensure that all candidates are treated equally and receive grades based on evidence-based demonstrated attainment against the national standard.

Work is at an early stage on this Programme for Government commitment and is currently focused on identifying best practice that can be used to inform the pilots. The opportunity to engage in this work will be available to all Local Authorities.

The aim is to build on existing good practice and tailor support to local needs. We are mindful that whilst the majority who leave school before the end of S5 progress to positive destinations, the rates are lower than for older pupils, so we have a particular interest in these groups. The Scottish Government is committed to ensuring every young person leaves school with the skills and confidence to succeed in whatever path they choose – regardless of background or location.

We expect to provide hybrid closed loop systems to at least 2500 people in the financial year 2025-2026. This builds on the more than 2100 people who received a hybrid closed loop system in 2024-2025.

The approach of this programme allows boards to manage their own financial allocation, but we expect children and young people to be prioritised, including those newly diagnosed across the year. This means it is not possible to provide an exact breakdown between adults and children but reporting across the year will allow us to track this nationally.

However, any child or young person living with Type 1 diabetes in Scotland should now have had, at minimum, a referral to receive a closed loop system.

Decisions on the Review of Electricity Market Arrangements (REMA) are reserved to the UK Government. The UK Government has published impact assessments and is updating its analysis ahead of a final decision this summer. We are awaiting sight of this updated modelling.

In addition, a range of impact assessments have been carried out by consultancies and industry bodies.

We met with researchers, industry and consumer organisations – as well as international electricity market experts – in December 2024 to consider the evidence and have engaged extensively with stakeholders over the past two years to understand all impacts.

This is a complex area and the Scottish Government is clear that UK Government reforms must reduce costs for Scottish consumers, ensure Scotland’s communities feel the benefit of the energy transition and protect investment in our renewables industry and supporting decarbonisation.

I can confirm that all Ministers accepted the equalisation of the MSP element of their salary, with the exception of the First Minister who chose not to do so to avoid any perception that he was personally benefiting from his own decisions on Ministerial pay.

Although widespread across all ages and demographics, data tells us that disabled people, young people (16-24), people over 75 and those on low incomes are now the most at risk of social isolation and loneliness. To support the delivery of our Social Isolation and Loneliness Delivery Plan, we are providing £3.8m over three years to 53 community projects across Scotland through the Social Isolation and Loneliness Fund that is providing opportunities for people to connect. At the end of year one projects reached 11,293 individuals with a focus on priority groups most at risk of social isolation and loneliness. We also provide funding to Befriending Networks, who support befriending services across Scotland, and currently have 118 Scottish members.

As outlined in the response to S6W-32069 on 6 January 2025, the Scottish Government expects all NHS Boards to provide maternity services that are delivered as close to home as practicable, balanced with ensuring the safety of mother and baby. Within the policies we set, it is for NHS Boards to determine the model of service delivery best suited to meet the needs of their local areas and population.

All decisions about care throughout pregnancy, including around place of birth, should be made by women in discussion with their clinical team. These decisions will take account of their individual needs and circumstances. To support this, in February 2025 we published the new Pathway for Maternity Care. This sets out the core care that women and their babies should receive under a whole-person, individualised care approach which takes account of their specific circumstances. We also published the new Birthplace Decision leaflet to provide women with the up-to-date information they need to make informed decisions about where they would like to give birth.

Women will be given advice when they contact maternity triage services in labour to help them make decisions about when to travel to hospital, and on pain relief options available to them.

No changes are currently planned to the questions asked in the Scottish National Blood Transfusion Service (SNBTS) donor health check questionnaire as a result of the Supreme Court judgment. However, SNBTS will continue to review its polices in the light of any further guidance issued.

The Scottish Government is grateful to everyone who takes the time to volunteer to give blood. The questionnaire aims to treat all potential donors equitably, but it is essential that all questions are answered fully in order to ensure that blood can be donated safely. Nonetheless, the Scottish Government regrets any upset caused to people who are not able to donate blood as a result of not answering any of the questions in the questionnaire.

SNBTS adjusted the questionnaire in 2022 so that all donors are asked the same questions. In response to some concerns raised, SNBTS further amended the questionnaire in 2023 to make clear that if the question about whether a donor might be pregnant is not applicable then donors should tick ‘No’. Although some questions will not be relevant for many donors – male and female – the questionnaire is the most practical way of asking sensitive questions in a busy donor environment. Staff cannot know or make assumptions in all cases about a person’s biological sex, so the current approach avoids any risk that someone who could be pregnant does not answer the pregnancy question.

Salmon farming is regulated primarily as development by Local Authorities through planning permissions granted under the Town and Country Planning (Scotland) Act 1997. Other consents can include a seabed lease from Crown Estate Scotland, a licence from the Scottish Environmental Protection Agency (“SEPA”) under the Water Environment (Controlled Activities) (Scotland) Regulations 2011 and a Marine Licence from the Scottish Government's Marine Directorate - Licensing Operations Team for the deposit of equipment under the Marine (Scotland) Act 2010.

Incidents of marine pollution are typically reported to the Maritime and Coastguard Agency (“MCA”), who then inform other relevant authorities. Where pollution is suspected to be associated with an aquaculture site, SEPA has primacy in investigating the cause and considering any potential sanctions.

In cases of pollution elsewhere than at an aquaculture site, the Scottish Government’s Marine Directorate can investigate and it can take action if the evidence indicates that an offence under the Marine (Scotland) Act 2010 has been committed. This can include cases of unlicensed deposits of a substance or object into the marine environment or a failure to comply with the conditions of a licensed activity.

In the case of a vessel sinking, the responsible authority is the MCA and it directs any salvage operations through powers held by the Secretary of State’s Representative for Maritime Salvage and Intervention (“SOSREP”). The MCA also has responsibility for pollution emanating from vessels under the International Convention for the Prevention of Pollution from Ships (“MarPol”).
