The Scottish Civil Justice Council is a body independent of the Scottish Government, which has responsibility for drafting rules of procedure for the civil courts. We will await the outcome of the current review before taking a view on whether the requirements of Article 9(4) of the Aarhus Convention and findings of the Aarhus Convention Compliance Committee in Decision VII/8s of October 2021 are addressed.

The Scottish Government is absolutely committed to an infrastructure solution to address the landslip risks at the A83 Rest and Be Thankful. I share the urgency communities and businesses place on maintaining and improving connectivity of this vital route, which is why we are progressing measures for the short, medium and long term in tandem.

On 2 June 2023 the preferred route for the permanent, long-term solution at the Rest and Be Thankful was announced consisting of an online option with a 1.4 kilometre long debris flow shelter. Accompanying this announcement, the Design Manual for Roads and Bridges Stage 2 Assessment Report was published and includes the current estimated cost of the preferred option which is approximately £405 million - £470 million (at 2023 prices).

Although through The Land Reform (Scotland) Act, access is free to most outdoor spaces and the use of public and active transport is encouraged, The Scottish Government appreciates that many of our rural outdoor spaces can only be easily accessed by motorised vehicles.

The Scottish Government is in close discussion with Forestry and Land Scotland to see what further mitigations can be put in place to ensure the correct balance between free access to Scotland's national forests and land both during the current economic climate and beyond and the need to sustainably manage our forests and encourage responsible vehicle use and active transport, mitigate safety and environmental impacts at popular sites and support the net zero challenge.

The Scottish Government wants children to grow up loved, safe and respected and to fulfil their potential, and our third sector partners play a critical role in achieving this.

We are providing over £34 million to a wide range of third sector organisations who are delivering support to families through a number of programmes – the Whole Family Wellbeing Fund, the Children, Young People and Families Early Intervention & Adult Learning & Empowering Communities third sector fund, the Residential Rehabilitation Rapid Capacity Programme, the Drug and Alcohol Services – Improving Holistic Family Support Framework - as well as through direct grant funding to organisations who are providing relationship support and support to families affected by imprisonment.

The investment of over £400 million that we are making through the R100 North contract is directly benefitting communities on the Orkney Islands. Building on the seven new subsea fibre optic cables connecting islands across Orkney concluded last year, with terrestrial build now underway to connect over 3,300 premises across the local authority area to full-fibre, Gigabit-capable connectivity.

Of course, mobile connectivity is just as vital as broadband connectivity for island communities, and the four masts we have delivered in Orkney through the S4GI programme will greatly extend 4G coverage and enable superfast connectivity for many.

Concerns regarding accommodation costs during the August Festivals pre-date short-term licensing mandatory standards, whereby the success of festivals and tourism within Scotland in recent years has seen increased visitors during peak holiday periods, which has resulted in higher demand for accommodation in the central Edinburgh area.

Short-term lets continue to be a growing sector and as such Scotland is not alone globally in deciding to regulate the sector. Licensing is now in place to ensure short-term lets are safe and the people providing them are suitable. Guests can have confidence that licensed hosts and accommodation have reached a recognised standard of assurance complying with mandatory conditions such as fire, gas, water and electrical safety. Many hosts are already complying with these through existing law or best practice, and we do not consider them onerous.

This additional assurance is expected to enhance Edinburgh’s reputation as an attractive, high quality, all-year round destination and help towards delivering the six-council City Region Regional Prosperity Framework Delivery Plan & 2023-24 Prospectus. 39% of the 2.2 million tickets for the Edinburgh Festival Fringe in 2022 were sold to Edinburgh locals, which was an increase of 4% on 2019, pre-COVID figures.

We continue to work with Festivals Edinburgh, the City of Edinburgh Council and industry groups (such as the Events Industry Advisory Group) to continue to support them to build on this success, and to address associated challenges. This is in addition to our continued support to the sector, including fourteen major festivals in Edinburgh and Glasgow receiving a share of this year’s £1.8 million Expo Fund.

We expect all grant recipients to comply with grant conditions. A grant offer letter is a contract, therefore non-compliance is a breach of this, and should be dealt with in line with existing guidance. The Scottish Public Finance Manual sets out the process for applying a clawback condition on funds, if reasonable and appropriate to do so.

We have published updated Fair Work First guidance to support grant recipients and fund administrators to apply the conditions effectively.

Our key priority throughout the stocks and negotiations is always to protect Scottish interests by securing sustainable catching opportunities.

Bluefin tuna quota is allocated to the UK via International Commission for the Conservation of Atlantic Tunas (ICCAT) and for 2023 the UK Government intends to trial a small-scale commercial fishery for Bluefin tuna in UK waters with 39 tonnes set aside quota for this purpose. All UK vessels, including the Scottish fishing fleet, will be able to apply for the trial this year.

My officials have been fully involved in discussions within the UK to ensure that, upon the opening of the application process, applicants will be assessed in a fair and transparent manner to select who will be issued with one of the 10 Bluefin tuna licences. Each licence will regulate the maximum quota which may be fished for the period of the 2023 trial, and which will also be non-transferrable. Under this scheme, Bluefin tuna quota is therefore currently managed at a UK level, rather than being apportioned between UK Fisheries Administrations.

Prior to the commencement of the trial, it is essential that a precautionary management approach is fully developed to ensure that Bluefin tuna fishing is sustainable, and that vessels are fully compliant with all relevant measures.

Forestry and Land Scotland (FLS) take the protection of (a) raptors, (b) red squirrels and (c) other protected woodland fauna within our woodlands very seriously, and when appropriate conduct our operations outwith their breeding seasons to avoid disturbance.

FLS adhere to the industry guidance set by the Scottish Government forestry regulator, Scottish Forestry, and where necessary apply for and follow the species licencing process regulated by NatureScot.

FLS have rigorous planning systems, checks and procedures with accompanying guidance to ensure all regulations and licence requirements to protect species are followed.

The Hydrogen Innovation Scheme received a total of 74 applications with 32 successful projects offered grant funding.

Unsuccessful applicants to the scheme were directed to potential alternative sources of assistance, including available business grants and other funding calls and the SME Loan and Cashback Scheme which provides interest free loans (from £1,000 up to £100,000) to small and medium sized Scotland based businesses.
