Information on local authority spend on their professional learning is not held nationally by the Scottish Government. Local authorities are best placed to advise on their spend in this area.

In 2022, we ran a public consultation on the draft of the new physical intervention in schools guidance Physical intervention in schools: draft guidance - gov.scot (www.gov.scot) . The draft human rights-based guidance is clear that restraint and seclusion should only ever be used as a last resort and to prevent a child or young person coming to harm. This position is also clear in existing guidance on the use of physical intervention and seclusion.

The draft guidance includes links to free professional learning resources that are focussed on promoting positive relationships and behaviour to minimise the use of restraint and seclusion. The draft guidance also recommends that the any training in the use of restraint is certified as complying with Restraint Reduction Network (RRN) training standards.

We are carefully considering all consultation responses received and recognise that there are calls for further legislation in this area. A consultation analysis report is currently being prepared. Alongside the publication of the guidance, and in line with our original commitments, we are exploring options to strengthen the legal framework in this area, including placing the guidance on a statutory basis.

The number of households in each local authority that are experiencing fuel poverty is published annually (based on a three-year average) in the Scottish House Condition Survey (SHCS) local authority tables starting with the 2003-2006 publication.

Please Note:

Results from 2016-18 to 2017-19 are based on best estimates under the new definition of fuel poverty as set out in the Fuel Poverty (Targets, Definition and Strategy) (Scotland) Act 2019. They reflect amendments made to the legislation during the Bill process up to and including Stage 2.

Results from 2003-06 to 2015-17 are based on the definition of fuel poverty set out in The Scottish fuel Poverty statement 2002 .

As the 2020 SHCS was suspended due to the Covid-19 pandemic and results from the 2021 External+ SHCS are not yet published and unlikely to be consistent with previous years, the 2017-2019 results are the latest available at Local Authority level.

Due to the recent rise in energy prices and lack of recent SHCS data on fuel poverty, we have published scenario modelling of national fuel poverty rates under the Energy Price Guarantee, at both the current £2,500 level from October 2022 as well as the £3,000 level from April 2023.

This modelling estimates that from October 2022 there are around 860,000 households (35%) in fuel poverty in Scotland. This is an increase of 247,000 households or around 10 percentage points from the latest available 2019 SHCS statistics, which showed 613,000 households in fuel poverty (25%). With the increase in the Energy Price Guarantee to £3,000 in April 2023 we estimate that around 980,000 households (39%) in Scotland will be in fuel poverty. While these modelled estimates are not available at Local Authority level, the large increases in the fuel poverty rate will be reflected across each Local Authority in Scotland.

Prompt payment of the supply chain is not only the ethical and socially responsible thing to do, it is critical to the sustainability and resilience of our supply chains in delivering critical products, services or works to, or on behalf, of the people of Scotland. The Scottish Government is committed to paying our contractors promptly and ensuring that they do the same with their subcontractors. There is already a significant range of measures in place in Scotland to tackle late payment in both public and private contracts through legislation, policy and practice.

The Scottish Government continues to lead by example through our target to pay all valid invoices within 10 days of receipt whereas our statutory obligation is 30 days. For financial year 2021-2022, 97% of valid invoices received were paid within 10 days and 99% paid within 30 days.

The Scottish Government sought views in our 2020 Public Procurement Survey of Suppliers, where 85% of respondents were SMEs. The survey included a number of questions on payment performance, and identified opportunities to improve payment performance, particularly for sub-contractors in supply chains.

As a result the Scottish Government worked alongside public bodies, supplier groups and other stakeholders to bolster the Scottish Government’s prompt payment policy. An updated procurement policy note was published in April 2022 which was welcomed by the Federation of Small Businesses and the Small Business Commissioner. The updated policy encourages public bodies to consider bidders past payment performance during tender exercises, and to request bidders confirm that their terms & conditions for all sub-contractors will contain a prompt payment clause, driving payment of valid invoices within a maximum of 30 days throughout the full supply chain for public contracts.

Scottish Government Procurement officials continue to support the updated policy implementation and work with stakeholders to determine how to monitor the extent to which the policy is embedded within public bodies procurement processes.

In terms of payment in advance, the Scottish Public Finance Manual states that advance payments should only be made in exceptional circumstances, where good value for money can be made from them and all reasonable steps should be taken to protect public funds.

Scottish Government Human Resources does not hold a central record of the creation or approval of new posts, this process is handled by individual business areas under the direction and approval of a Director. There is no single Directorate responsible for all rural and island based staff.

To provide information that is equivalent to the creation of posts, we have:

• Identified SG offices in rural and island locations based on categorisation established by National Records of Scotland or by Local Authority.
• Provided the headcount of directly employed staff at those locations in each of the last 5 years, with the year-on-year change indicating instances when new posts may have been created.

Our most recently published data are at 30 September 2022. 30 September has been used as the reference date each year for comparison purposes. These data cover staff in Scottish Government Core Directorates only.

Skills Development Scotland deliver careers services to all 358 publicly funded secondary schools in Scotland.

The Scottish Government worked with Skills Development Scotland, Highlands and Islands Enterprise and others in the aquaculture sector to develop an Aquaculture Skills Action Plan in December 2018. The Action Plan was developed following a sector skills review ‘Skills review for the aquaculture sector in Scotland’, undertaken on behalf of Highlands and Islands Enterprise and published in the same year.

Lantra is the skills interests organisation of land-based, aquaculture and environmental conservation businesses and organisations across Scotland, and their activities are supported by the Scottish Government. Lantra coordinate the Aquaculture Skills Group that progresses the Aquaculture Skills Plan, with support from the Sustainable Aquaculture Innovation Centre and other stakeholders in the aquaculture sector.

The Scottish Government is also considering the skills and development opportunities required for aquaculture and other land-based sectors through the work of the independent Commission for the Land-Based Learning Review. The Commission reported the conclusion of its review in January 2023. As committed to in the Programme for Government, we will consider the recommendations made by the Commission in its review and produce a response.

The Scottish Government has issued the following guidance regarding “purposeful walkers” and use of restraint practices in hospitals and care homes:

The Scottish Government is committed to improving fair work practices across the social care sector.

There are more than 1,200 social care providers across Scotland; and each of these providers will have their own internal pay scales.

Since 2016, the Scottish Government has delivered funding to ensure adult social care workers are paid at least the Real Living Wage (RLW). Our ambition is that all care workers, including those working in the children’s sector, are paid the Real Living Wage as a minimum. Work to better understand the current composition of the Children’s social care sector is taking place in collaboration with key stakeholders.
