Officials met with representatives from British Glass on 2 May to discuss the Deposit Return Scheme. Officials were clear in that meeting that Ministers strongly believe in the inclusion of glass in the DRS, due to the environmental and economic benefits this would bring and in line with the shared understanding across the UK at the time the Scottish regulations were approved. Officials will continue to engage with British Glass at appropriate times in the future, in line with wider stakeholder engagement.

The Scottish Government and Zero Waste Scotland consulted several organisations including Disability Equality Scotland and Inclusion Scotland in the process of assessing the potential impacts of the Deposit Return Scheme. This was accounted for in the Final Equality Impact Assessment, published in March 2020 and available at A Deposit Return Scheme for Scotland : Final Equality Impact Assessment (www.gov.scot).

The Ministerial Strategic Assurance Group was established as part of the refreshed system wide governance for the Deposit Return Scheme in Scotland (DRS) for the implementation stage of the programme. The function of this group is:

• To provide collective strategic assurance of successful DRS implementation.
• To hold all stakeholders mutually accountable for requisite actions.
• To build consensus on issues where there is conflict in stakeholders’ positions.

? To drive down the number of outstanding operational issues.

? To manage resolution issues escalated to the Group.

The Scottish Government is committed to transparency and openness. We aim to publish key information such as notes of meetings and letters relating to the deposit return scheme as soon as possible.

The Scottish Government has undertaken extensive analysis of the impact of Scotland’s Deposit Return Scheme on recycling rates of both glass and plastic.

Scotland’s DRS will target a recycling rate of 90% of scheme articles by the third year of DRS being operational for both plastic and glass. Current recycling rates are around 50% for PET plastic and 63% for glass.

We expect to collect an extra 14,500 tonnes per year of plastic resulting in a CO2eq saving of 31,000 tonnes of carbon when the scheme launches. The UK Government’s intervention through the Internal Market Act Exclusion will delay these benefits by at least 19 months.

The Scottish Government has always been clear that we will work closely with the UK and devolved Governments to maximise interoperability of the schemes, while acknowledging that waste and recycling policy is fully devolved.

In order to do this, the UK Government must provide clarity on its own deposit return scheme by introducing regulations for its scheme as soon as possible.

I wrote to the Secretary of State for Environment, Food and Rural Affairs and Defra’s Minister for Environmental Quality and Resilience on 6 June setting out that I was keen to work collaboratively with other administrations across the UK to push forward work on issues around interoperability, while ensuring that the wishes and competence of the Scottish Parliament are respected.

The Implementation Advisory Group (IAG) was formed when Zero Waste Scotland was developing DRS, carrying out associated impact assessments and working with Scottish Government to develop and lay the original DRS regulations. It met during 2019 and 2020 and was then disbanded once the regulations were laid as ‘ownership’ of the scheme was then passed on to the Scheme Administrator.

The Scottish Government has received legal advice on matters relating to DRS on an ongoing basis as appropriate. The content of any legal advice is confidential. By long-standing convention, successive Scottish and Westminster Governments have not disclosed the source or content of legal advice other than in the most exceptional circumstances.
