The Scottish Government is currently conducting a programme of work to reform and modernise compulsory purchase to make the system simpler, more streamlined and fairer for all parties. The reforms are intended to support the delivery of all types of project, not just those related to renewable energy infrastructure, net zero and climate adaptation. Our aim is to move towards a system that is:

• Equitable: compensating claimants fairly and timeously;
• Effective: supporting efficient decision-making, whilst ensuring procedural fairness, openness, and transparency; and
• Easy to understand, providing all parties with certainty and clarity about how the process works and their rights, roles and responsibilities within it.

In March 2024, we appointed an expert advisory group to help support the reform process. We are working with the advisory group and engaging with a range of stakeholders to develop reform proposals ahead of a public consultation later this year. The Scottish Government uses robust contract management procedures in relation to the procurement and compliance of licensing agreements for software subscriptions, procuring through national public procurement frameworks to ensure transparency, quality and value for money. Criteria will vary depending on business needs, costs and value.

Scottish Government costs directly associated with the implementation of compulsory purchase orders cannot be disaggregated within the cost information that we hold.

The Scottish Government regularly publishes a register of compulsory purchase orders (CPOs) submitted to the Scottish Ministers for confirmation since 2012: https://www.gov.scot/publications/compulsory-purchase-order-register/. The current register, published in December, includes CPOs received up to the end of October 2024.

The register includes information on when a CPO is submitted, who the acquiring authority (i.e. body with compulsory purchase powers) is, the date of the Scottish Ministers’ decision on confirmation, a description of the project, the location, including local authority area, the type of CPO (for example, for Planning, Housing, Energy or Transport purposes) and legislation under which it was made.

CPOs are recorded in the register by local authority area. In the five years to 31 October 2024, the top four such areas for CPOs confirmed or confirmed with modifications were:

• Glasgow City 27 (Housing 25 and Planning 2)
• Highland 6 (Transport 5 and Environment (Water) 1)
• Perth and Kinross 5 (Transport 4 and Planning 1)
• Falkirk 5 (Transport 4 and Energy (Gas) 1)

The Scottish Government have terminated software subscriptions for several operational reasons. These include non-renewal on contract expiry, replacement with more modern services and the loss of business requirement to run the software.

The Scottish Government is committed to supporting the delivery of national emissions reduction targets, directed by our new Carbon Management Plan. As part of ongoing maintenance and upgrades within our buildings, we aim to incorporate energy efficiency improvements alongside these works wherever possible.

There are 6 buildings with Solar PV, 1 building with an air source heat pump, 2 buildings with biomass heating.

The solar PV provides approximately 5% of each of the building’s total electricity use.

The air source heat pump replaced a gas boiler.

The biomass boilers replaced gas and oil heating at rural locations.

All buildings owned by the Scottish Government use electricity supplied via a REGO tariff (Renewable Energy Guarantees of Origin).

6 buildings have solar PV which contributes approximately 5% of each building’s electricity use. 1 building has an air source heat pump which provides 100% of the buildings heating requirements.
